§ 118-93. Issuance.

  • (a)

    Variances from this chapter shall only be issued upon:

    (1)

    A showing of good and sufficient cause;

    (2)

    A determination that failure to grant the variance would result in exceptional hardship to the applicant; and

    (3)

    A determination that the granting of variance will not:

    a.

    Result in increased visual obstruction on any highway, street or road within the viewing area of such sign;

    b.

    Result in additional threats to public safety;

    c.

    Result in public expense;

    d.

    Create nuisances;

    e.

    Cause fraud on or victimization of the public;

    f.

    Be injurious to other property in the area; or

    g.

    Conflict with existing local laws or ordinances.

    (b)

    Pecuniary hardship to the property owner or sign owner shall not be sufficient reason, standing alone, to constitute hardship requiring a variance.
