§ 18-1135. Inspection, repair and maintenance.

(a)

The owner, tenant, property owners' association or any other person who owns, controls or maintains a pool shall exercise ordinary and reasonable care to inspect, maintain, repair and keep in good working order the pool yard enclosures, gates and self-closing and self-latching devices, as may be required by this division.

(b)

Any person who owns, controls or maintains a public swimming pool shall inspect the pool yard enclosures, gates and self-closing and self-latching devices on gates no less than once every 31 days.

(c)

The duty of inspection, repair and maintenance under this section may not be waived under any circumstances.
